How does the NYC Child Victims Act affect my school sexual abuse claim?

On February 14, 2019, Governor Cuomo signed a new law called the New York Child Victims Act. It expanded options for those pursuing civil claims in childhood sexual abuse cases.

  • Expanding the statute of limitations to a victim’s 55th birthday
  • Allowing survivors to bring criminal charges against an offender until the victim’s 28th birthday
  • Adding a one-year lookback period where abuse survivors could file a suit, regardless of their age or missing the statute of limitations (This period expired on August 1, 2021.)

Anyone can file a claim under the act if they survived sexual abuse as a minor and suffered physical, emotional, or psychological trauma. It includes victims who previously filed a lawsuit but had it dismissed due to an expired statute of limitations. 

The law includes all claims, including those against organizations with heightened accessibility to children, like public schools, the boy scouts, and the Catholic Church. It expands the class of people eligible to file lawsuits, which allows more people to hold their abusers accountable. 

How common is sexual abuse at New York City public schools?

There aren’t many reliable sources reporting sexual abuse in NYC public schools. But national sources show there is a trend, and New York has shortcomings regarding school sexual abuse. 

Data from the U.S. Department of Education’s Office for Civil Rights revealed 14,938 incidents of sexual abuse in K-12 schools in 2017 and 2018. This number was a 55% increase from 2015 to 2016, when reports showed 9,649 incidents. 

New York isn’t immune from these national resources. The New York Department of Education paid out a $700,000 court settlement after ignoring reports from students who survived sexual assault. Offenses included verbal abuse, groping, and rape.
