Dr. Amir Sitafalwalla’s History of Sexually Abusing Patients

According to investigations conducted by the Department of Health and the Queens District Attorney’s Office, Amir Sitafalwalla allegedly has a history of sexually abusing patients spanning nearly a decade, including incidents prior to his employment at ModernMD Woodhaven.

Alarmingly, Sitafalwalla was arrested twice for complaints of sexual abuse — once in March 2023 and again in September 2024. Following the first arrest, he returned to ModernMD Woodhaven, where he continued to abuse patients until his second arrest.

Due to ModernMD’s alleged negligence, multiple patients were wrongfully put at risk. Victims have reported that Sitafalwalla engaged in abusive behavior such as:

  • Performing unnecessary medical exams for sexual gratification
  • Groping and touching patients' genitals without medical justification or gloves
  • Forcibly kissing patients
  • Digital penetration of patients' genitals
  • Making sexually explicit, inappropriate comments regarding bodies or sexuality

Sitafalwalla ultimately pled guilty to engaging in misconduct with five victims, including a minor. He was sentenced to 6 years of probation, ordered to register as a level 2 sex offender, and his medical license was suspended.

Negligence at ModernMD and Prior Abuse at CityMD

Abuse Prior to Employment at ModernMD

Before joining ModernMD Woodhaven, Sitafalwalla was employed as an urgent care doctor by CityMD Bayside, where he allegedly sexually abused at least two patients.

Upon information and belief, in March 2021, CityMD Bayside received a complaint regarding sexual abuse, which resulted in his termination. In May of that year, he was informed that he was being investigated by the Department of Health Office of Professional Misconduct.

Abuse at ModernMD Woodhaven Urgent Care

Despite Sitafalwalla’s termination for allegations of sexual abuse, Sitafalwalla was hired by ModernMD Woodhaven urgent care where he continued to target and sexually abuse numerous patients.

Evidently, it appears that ModernMD Urgent Care failed to thoroughly investigate Amir Sitafalwalla’s employment history, which would have revealed his history of allegedly sexually abusing numerous patients.

Timeline of Arrests and Sentencing

January 2023: First Arrest

After sexually assaulting one victim at ModernMD Urgent Care, Sitafalwalla was arrested, and criminal charges were brought against him in March of 2023. However, ModernMD Urgent Care seemingly neglected to investigate Sitafalwalla’s abusive behavior following his arrest which only further emboldened him to sexually assault more victims.

Evidently, Sitafalwalla was not deterred by his pending criminal charges or arrest, and he continued to deliberately target, harass, and sexually abuse patients following this incident. Less than a year after his first arrest, and with criminal charges still pending, Sitafalwalla allegedly sexually abused at least five additional patients while employed at ModernMD Urgent Care.

September 2024: Second Arrest

In September 2024, Sitafalwalla was arrested and criminally charged for a second time after one of his victims reported his abuse to the police.

Sitafalwalla ultimately pled guilty to five counts of forcible touching as to four different victims, and one count of sexual abuse in the third degree as to one additional victim in September 2025.

April 2025: License Suspension

In addition, Sitafalwalla’s medical license was suspended in April 2025 when the Department of Health Office of Professional Misconduct uncovered Sitafalwalla’s horrific history of sexual abuse dating back to 2017. The Department of Health ordered that Sitafalwalla could no longer practice medicine in the state of New York and stated that Sitafalwalla was engaging in activities which constituted an “imminent danger to the health of the people”.

January 2026: Sentencing

Sitafalwalla was sentenced to six years of probation and ordered to register as a level two sex offender.

Attorney Hardeep Shergill, Esq. of the Jacob Fuchsberg Law Firm was present at the sentencing in support of our clients who read a victim impact statement during Sitafalwalla’s sentencing.

Understanding Physician Sexual Abuse in New York

Physician sexual abuse is a profound betrayal of trust. Doctors hold a unique position of authority, and patients rely on them for care and safety. Unfortunately, predators often exploit this vulnerability, using the guise of medical examinations to target victims behind closed doors.

In most cases, physician sexual abuse does not occur as an isolated incident. Instead, it is often indicative of a pattern of predatory behavior that has been left unchecked by the medical facility. Hospitals, urgent care centers, and private practices have a duty to monitor their staff and implement safeguards — such as requiring chaperones during sensitive exams. When they fail to do so, they may be held liable for the resulting harm.

Common forms of physician sexual misconduct include:

  • Forcible sexual contact: This includes rape, unwanted kissing, groping, or fondling of private areas without medical necessity.
  • Inappropriate touching: Conducting exams without gloves or touching genitals in a way that is not medically justified.
  • Sexual behavior in the presence of patients: Such as masturbating or exposing themselves.
  • Verbal abuse: Making sexually explicit, suggestive, or inappropriate comments regarding a patient's body or sexual history.

The impact of this abuse extends far beyond the physical incident. Victims often suffer unique psychological trauma, including depression, anger, low self-esteem, anxiety, and a lasting fear of medical professionals (white coat hypertension), which can prevent them from seeking necessary healthcare in the future.

I cannot rate the firm any higher! we are extremely happy with the service we received from Brad, Chris and the team. We are northern Irish citizens and as such had no experience of the US justice system, Chris and Brad helped us navigate this and made sure we understood every step of the process and we were kept informed of what would happen with the case.

We also felt that Brad and Chris had a genuine interest in our story, what the implications for us as a family were and they were genuinely invested in how they could help our situation.

We were reassured by the manor in which Chris and Brad dealt with us and trusted that the advice we were given was always well balanced and in our best interests. We were extremely happy with the outcome the firm achieved for us and feel that we only got this outcome due to the hard work of Chris and Brad. I would not hesitate to recommend the firm to anyone who is considering a case and wants to feel as though they are really valued as a client.

Many thanks to the firm for all of their hard work on our behalf it truly is appreciated.

FAQ

Frequently Asked Questions

Can I still file a lawsuit if Dr. Sitafalwalla has already been sentenced?

Arrow icon

Yes. The criminal justice system is designed to punish the offender, often resulting in probation or prison time. However, it does not provide financial compensation to the victim for their trauma, medical bills, and pain and suffering. You can file a civil lawsuit to recover damages even if the doctor has already been convicted and sentenced.

Can ModernMD or CityMD be held liable for the abuse?

Arrow icon

Yes. Medical facilities have a legal duty to protect their patients. If ModernMD or CityMD failed to conduct proper background checks, ignored complaints, or negligently retained Dr. Sitafalwalla despite knowing he was a risk to patients, they can be held liable for the harm he caused. Our attorneys are actively litigating against these institutions for their negligence.

Will my identity be kept confidential?

Arrow icon

We understand that privacy is a major concern for survivors of sexual abuse. In civil lawsuits involving sexual assault, victims are often permitted to proceed under a pseudonym (e.g., "Jane Doe") to protect their identity from the public record. Our firm takes every possible measure to ensure your privacy and dignity are protected throughout the legal process.

How much does it cost to hire a sexual abuse lawyer?

Arrow icon

There are no upfront costs. The Jacob D. Fuchsberg Law Firm works on a contingency fee basis. This means you do not pay any attorney's fees unless we successfully recover compensation for you through a settlement or verdict.

What is the deadline for filing a claim?

Arrow icon

Under New York law, adult survivors generally have 10 years from the date of the assault to file a civil lawsuit against the abuser and the negligent institution. However, because this case involves a medical professional, certain claims related to medical malpractice may be subject to a shorter 2.5-year deadline. Do not assume you have time — contact us immediately to ensure your claim is filed within the correct legal timeframe.
