Walter Osuna obtained a significant award on behalf of a 53-year-old father and husband who tragically passed away as a result of a delayed pulmonary embolism diagnosis. Despite the fact that our client exhibited classic signs and symptoms of a pulmonary embolism, doctors failed to adequately work up his symptoms for nearly 10 hours, which caused our client to suffer from cardiac arrest and ultimately pass away. Our client was survived by his wife and two minor children.
The day prior to his passing, our client presented to the hospital with complaints of right knee pain after a fall. Our client was admitted to the hospital and diagnosed with a fracture and decreased blood flow to the leg. Shortly after his admission, doctors performed multiple surgeries on our client, including orthopedic surgery and vascular surgery in addition to an incision and closure of the wound.
Notably, our client’s past medical history put him at an elevated risk of developing a blood clot, therefore his attending team should have paid close attention to his vitals to ensure that he was not exhibiting symptoms that could be indicative of a blood clot such as swelling, skin discoloration, shortness of breath, elevated heart rate, etc.
In fact, while in the hospital, our client began to suffer from a swollen lower calf and fevers which persisted for hours. The day following his surgeries, our client displayed alarming symptoms of an elevated heart rate and decreased oxygen saturation for over nine hours which were not immediately attended to. It was only after this significant delay that the hospital initiated pulmonary embolism protocol and administered anticoagulant medication.
Unfortunately, by the time doctors finally diagnosed our client’s pulmonary embolism, it was too late. Our client tragically suffered from a cardiac arrest and passed away shortly after he began receiving anticoagulant medication. An autopsy of our client confirmed that our client’s cause of death was deep vein thrombosis due to limited mobility following his fracture.
