31-Year-Old Suffers from Stage IV Breast Cancer Due to Doctor’s Failure to Perform Biopsy Years Prior

Two years before her diagnosis, our client presented to her gynecologist with complaints of a mass in her breast, which her gynecologist immediately assessed via ultrasound. Our client was promptly referred to the defendant doctor for a surgical oncology evaluation with the recommendation that the defendant perform a biopsy for further evaluation.

Unfortunately, despite the recommendation for a biopsy, the defendant doctor failed to perform appropriate tests to rule out cancer and instead improperly presumed and misdiagnosed our client with a non-cancerous mass.

As a result of the misdiagnosis, our client’s cancer was left untreated for approximately six months, and her cancer worsened considerably. When our client returned for a follow-up appointment later that year, imaging revealed that our client was suffering from Stage III breast cancer. Unfortunately, our client’s cancer metastasized to her lungs and lymph nodes, and she was ultimately diagnosed with Stage IV, incurable cancer.
