Walter Osuna and Bradely Zimmerman obtained a significant settlement on behalf of a 32-year-old woman whose untreated uterine infection following a c-section resulted in a hysterectomy and unfortunately left our client unable to bear more children. Our client was a registered ICU nurse and repeatedly attempted to advocate for herself during the course of her treatment, but unfortunately, her complaints were overlooked for weeks until it was too late.

At the time, our client was pregnant with her first child and was scheduled to be induced at forty weeks. On the date of her scheduled induction, our client was in labor for 33 hours without success, so her care team opted to perform a c-section the following day. Fortunately, the baby was delivered without significant issues; however, our client began to display alarming symptoms within a few days after giving birth.

What should have been a cherished time between our client and her newborn was promptly sidelined by our client’s rapidly deteriorating health. Two days after our client’s c-section, our client began to suffer from shivers and low-grade fevers followed by an elevated white blood cell count, which should have prompted doctors to investigate. However, our client was only treated with Tylenol and a short course of antibiotics, without ever receiving a differential diagnosis.

As a nurse herself, our client was well-aware that the presence of these prolonged symptoms so soon after giving birth was extremely alarming and warranted further evaluation; however our client’s repeated complaints were dismissed by her care team.

Our client deteriorated further and developed nausea with high grade fevers, which finally prompted an evaluation by an infectious disease doctor. Unfortunately, by the time doctors finally investigated our client’s symptoms and correctly diagnosed our client’s uterine infection, it was too late. Our client underwent a hysterectomy and extremely invasive stomach surgeries. Alarmingly, part of the tissue removed from our client’s uterus was dead tissue, indicating that the infection had progressed so significantly to the point where her organ tissue was dying. Our client suffered tremendously due to the hospital’s delayed diagnosis and was tragically left with the inability to bear more children.

With the support of qualified disease experts, Walter Osuna demonstrated that the hospital’s failure to properly treat the infection, perform adequate testing, and administer proper antibiotics led to our client’s injuries. Walter Osuna and Bradley Zimmerman obtained a significant award on behalf of our client following an aggressive presentation during mediation.
