Walter Osuna

Walter Osuna has experience in handling personal injury, nursing home, and medical malpractice cases, and has written and argued appeals, summary judgment motions, and other procedural and discovery motions, and has vast experience in resolving matters through Alternative Dispute Resolution  methods, such as mediations. As a plaintiffs’ attorney, Walter has handle all aspects of litigation from case intake through trial and has assisting numerous individuals in achieving a successful resolution of their cases.

Walter earned a Bachelor of Arts, cum laude, in International Business at San Diego State University and earned his Juris Doctorate from Fordham University School of Law. During Law School, Walter was a Notes and Article Editor at Fordham’s Environment Law Review, served as a Board Member of the Fordham Student Sponsored Fellowship, and was a recipient of The Archibald R. Murray Public Service Award and Student Leadership Award for his involvement with several public interest organizations. He was also a part of the Community Economic Development Clinic as a student advocate, providing legal counseling to emerging social justice organizations during their incorporation process.  In addition, he completed internships at Legal Aid of Los Angeles Self-Help Access Center, assisting pro-se litigants in English and Spanish in completing civil court documents, and at the law firm of Richards, Cardinal Tutzer, Zavala & Zaefferer in Argentina.

Walter is admitted to practice in the States of New York, New Jersey, and California. As a native Spanish speaker, Walter is able to assist Spanish speaking litigants with expressing themselves, and they are able to ask questions and understand the process directly from their attorney in their own language.

Notable Verdicts & Settlements:

• ($4.375M) Failure to timely and properly treat a 46 year old male presenting with complaints of a prolonged erection or priapism, and failed to render appropriate post-operative care and adequately treat an infection, which caused him to sustain a severe penile abscess and trauma, erectile disfunction, sepsis, neurological impairments, chronic pain and need for numerous surgeries.
• ($2.375M) Delay of diagnosis of renal cell carcinoma on a 56 year old male for over two years despite diagnostic imaging demonstrating the presence of a mass and subsequent presentations with symptomatology consistent with this type of cancer, which caused metastasis to his lungs, pain and suffering, and increased chance of recurrence and reduced life expectancy.
•  ($2M) Delay of timely diagnosis and treatment of a 53 year-old male’s pulmonary embolism during an extended hospitalization despite sign, symptoms, and complaints consistent with the same, which lead to his untimely passing. He was survived by a spouse and two minor children.
• ($1.5M) 32-year-old woman who developed a post-C section uterine infection after her first child that was not timely and properly treated, developing uterine necrosis due to the delay and consequently she required a  hysterectomy and inability to bear any more children. 
• ($1.5M) 33 year-old woman who was caused to sustain pressure necrosis, burns, and tissue damage to her forehead due to excessively tighten bandages and application of improper solutions following a jaw reconstruction surgery,  which caused her to suffer severe scarring, disfigurement, and need for plastic surgery procedures to repair the extensive damage 
• ($1.35M) Failing to properly perform surgical procedures, including pull-through and loop colostomy, and render timely and adequate treatment to an infant born with imperforate anus and duodenal atresia, which lead to multiple additional surgeries, infections, and pain and suffering 
• ($1.25M) 62 year-old male who was improperly treated and monitored at the hospital following an admission for an allergic reaction to mediation that caused tongue swelling, which resulted in deprivation of adequate oxygen or hypoxia, respiratory and cardiac arrests, and premature death.  
• ($1M) Failure to timely diagnose and treat a cerebellar stroke on a 52 year-old male, who had presented with altered mental status to the emergency room. The delay caused brain stem herniation and cerebellar infarct and welling, which eventually lead to his premature death as a result of his brain injury.
• ($987,500) 70 year-old male confined to a wheelchair, who developed a wound on his toe that was not timely treated by his medical providers, which became severely infected, gangrenous, and necessitated amputations of his foot and leg, impacting further his already compromised mobility.
• ($875K) Failing to properly interpret imaging studies and timely diagnose a bowel obstruction on a 67 year old female with a history of gastric bypass surgery, who presented to the emergency room with symptoms consistent with the same and was prematurely discharged home as a result, leading to extensive bowel necrosis and gangrene, sepsis, and required months of rehabilitation.
• ($837,500), Failing to timely diagnosis an ischemic bowel on a 66 year old who had presented to the defendants’ facility for an elective cardiac catheterization. As a result of the delay, the patient required multiple surgical procedures and ultimately passed away due to the ensuing complications.
• ($800K) 40 year-old woman that developed an infection of her surgical incision after undergoing a C-section for the delivery of her first child, and was discharged home without proper medication and defendants failed to further evaluate despite numerous calls with complaints consistent with infection, which caused her to sustain necrotizing fasciitis, need for a hysterectomy, and inability to bear other children.
• ($804K) 77 year old woman with a history of congestive heart failure, who was prematurely discharged home without proper treatment after presenting to the emergency room and primary care clinic the same day despite her complaints of shortness of breath and chest pain and an extremely low ejection fraction evident on her diagnostic studies. As a result of the failure to treat the patient, she suffered a cardiac arrest the next day and passed away shortly thereafter.
