Babies Whose Mothers Were Addicted to Opioids May Have Substantial Claims

Opioid use in pregnancy has escalated dramatically in recent years, paralleling the epidemic observed in the general population. Many hundreds of thousands of mothers continue to use opioids during their pregnancies and give birth to babies who are also addicted.

Between 2000 and 2009, opioid use among women who gave birth increased in the United States from 1.19 to 5.63 per 1,000 hospital births per year. Dependence on opioids during pregnancy is associated with an increased risk of adverse outcomes for infants. They suffer from serious complications, including illnesses and birth defects.

These illnesses and conditions may include:

  • Conoventricular septal defects
  • Anencephaly/craniorachischisis
  • Spina bifida (or neural tube defects)
  • Heart issues
  • Cleft palate
  • Cleft lip with cleft palate
  • Cleft lip without cleft palate
  • Hydrocephaly
  • Cataracts
  • Esophageal atresia
  • Anorectal atresia/stenosis
  • Craniosynostosis
  • Diaphragmatic hernia
  • Gastroschisis
  • Aortic stenosis
  • Pulmonary valve stenosis
  • Transverse limb deficiency
  • Hypoplastic left heart syndrome and
  • Musculoskeletal disorders.

Infants may also be at risk of neonatal abstinence syndrome, which is a drug withdrawal syndrome. The rising prevalence of opioid use in pregnancy has led to a sharp increase in neonatal abstinence syndrome from 1.5 cases per 1,000 hospital births in 1999 to 6.0 per 1,000 hospital births in 2013, with an associated $1.5 billion in related annual hospital charges.
