Eli Fuchsberg Appointed to Exactech MDL Plaintiffs Leadership Counsel

The Jacob Fuchsberg Law Firm is proud to announce that Partner Eli Fuchsberg has been appointed to the Exactech Polyethylene Orthopedic Products Liability Litigation Plaintiffs Leadership Counsel. Eli Fuchsberg will be joining a select handful of distinguished attorneys from across the nation who are representing clients who were wrongfully injured by a defective knee, ankle, or hip replacement.

In February 2022, Exactech issued a recall of all polyethylene tibial, hip, knee, and ankle inserts manufactured in 2004 due to being placed in defective vacuum packaging that caused premature oxidation. Unfortunately, as a result of the premature oxidation, those who received the defective implants are more likely to experience bone loss, accelerated wear, debris production, cracking and fracture, and increased need for revision surgery.

The recall is expected to impact nearly 140,000 people and numerous lawsuits have already filed against the company. To accommodate for the high volume of cases, the Judicial Panel on Multidistrict Litigation officially consolidated all Exactech joint replacement recall lawsuits into a class action MDL centralized in the Eastern District of New York and led by Judge Nicholas G. Garafuis.

This August, Eli Fuchsberg was appointed to serve in the Plaintiffs Leadership Counsel where he will aid with the multidistrict litigation.

As a member of the counsel, Eli will collaborate with a diverse group of attorneys from over 10 different states to advance the needs of the case. The counsel will play an important role in ensuring that each plaintiff receives the in-depth representation they deserve.
