Complaint Filed on Behalf of 21-year-old who was Sexually Assaulted by Urgent Care Physician

On August 11, 2025, Jaehyun Oh, Esq. and Hardeep Shergill, Esq. of the Jacob D. Fuchsberg Law Firm filed a lawsuit on behalf of a 21-year-old young man who was sexually assaulted during an examination on or about August 14, 2024, by Dr. Amir Sitafalwalla, a then 72-year-old physician at Modern MD Woodhaven Urgent Care. Dr. Sitafalwalla was subsequently criminally charged for his sexual abuse of our client. 

Upon further investigation it was also revealed that Dr. Sitafalwalla was previously arrested for similar conduct just over a year prior to assaulting our client. Moreover, an investigation conducted by the New York State Department of Health found that Dr. Sitafalwalla had a nearly decade-long history of sexually abusing his patients. Following the investigation, Dr. Sitafalwalla’s medical license was suspended indefinitely. 

The Jacob D. Fuchsberg Law Firm filed a complaint against Modern MD Management Services, LLC, ModernMD Urgent Care – Woodhaven, and Dr. Sitafalwalla which alleges that Dr. Sitafalwalla was emboldened to sexually abuse several victims, including our client by Modern MD’s lack of oversight and disregard of clearly suspicious behavior.

Amir Sitafalwalla’s History of Sexually Abusing Patients 

Upon information and belief, Dr. Amir Sitafalwalla has a history of sexually abusing multiple of his patients, which dates back to at least 2017. Dr. Sitafalwalla allegedly followed a similar pattern during every abusive encounter: he primarily targeted young Hispanic male patients, and he committed sexually abusive behavior while alone with these patients in the examination room, under the guise of conducting a medical examination. Oftentimes, Dr. Sitafalwalla would allegedly perform “examinations” of the patients’ genitals even when not medically necessary, would grope and fondle the patients’ genitals, and would make sexually charged, inappropriate comments while committing the assaults. 

The Jacob D. Fuchsberg Law Firm uncovered at least 6 incidents of alleged sexual abuse, which were all prior to Dr. Sitafalwalla’s abuse of our client. 

Upon information and belief, Dr. Sitafalwalla reportedly sexually abused at least two patients while he was employed as a physician at CityMD Bayside prior to his employment at Modern MD Woodhaven Urgent Care. Following an investigation performed by CityMD for a report of sexual assault, Dr. Sitafalwalla was terminated from his position on or about April 29, 2021. 

However, despite Dr. Sitafalwalla’s alarming history and termination following an investigation for allegations of sexual abuse, he was hired by Modern MD Woodhaven Urgent Care at some point in 2021. The lawsuit alleges that Modern MD neglected to perform an independent investigation of Dr. Sitafalwalla’s employment application to ensure that he would be fit to work at their facility. 

As a result, once Dr. Sitafalwalla began working at Modern MD Woodhaven Urgent Care, he allegedly sexually abused at least 5 additional patients, including our client. Notably, Dr. Sitafalwalla was arrested for his alleged assault of one patient on or about January 27, 2023, and charged with forcible touch and sexual abuse on or about March 23, 2023. Despite his arrest, Modern MD failed to conduct an investigation of Dr. Sitafalwalla’s behavior or take any action against him to stop his predatory conduct.  

The complaint filed by the Jacob D. Fuchsberg Law Firm, LLP alleges that Dr. Sitafalwalla’s history of sexually abusing patients, including but not limited to his pattern of isolating young male patients to perform unnecessary medical exams and his prior arrest in March of 2023, should have prompted Modern MD to investigate and discipline Dr. Sitafalwalla. 

In addition, the complaint further alleges that Dr. Sitafalwalla’s behavior was or should have been obvious to other staff members at Modern MD who should have immediately reported his conduct. 

Our Client’s Story

Unfortunately, Plaintiffs allege, that despite Dr. Sitafalwalla’s long history of abuse, Modern MD allowed him to continue to practice at their facility and also allowed him to continue to treat patients alone, without a scribe or other medical supervision. 

Eventually, Dr. Sitafalwalla came into contact with our client on or about August 14, 2024. Our client presented to Modern MD Woodhaven for a checkup regarding irritation in the corner of his mouth and for routine STD testing. During the examination, Dr. Sitafalwalla instructed our client to pull down his pants for a genital examination despite the fact that our client denied having experienced any irregular symptoms that would have warranted a genital examination. 

Dr. Sitafalwalla proceeded to sexually assault our client by repeatedly rubbing his genitals in a sexual manner without our client’s consent while repeating inappropriate phrases. Dr. Sitafalwalla escalated his behavior by asking further invasive questions while he continued to assault our client. Once Dr. Sitafalwalla finished, he attempted to place our client’s genitals back inside his pants for him. Despite the fact that our client was deeply traumatized from this incident, Dr. Sitafalwalla continued to make inappropriate comments about our client’s physical appearance before leaving the room.  

Unfortunately, as a result of the incident, our client has experienced severe trauma, emotional distress, and other negative psychological symptoms. 

On the same day of his assault, our client courageously reported Dr. Sitafalwalla’s behavior to the police, and Dr. Sitafalwalla was subsequently criminally charged and arrested for his assault on or about September 9, 2024. In addition, the New York State Department of Health conducted an investigation of Dr. Sitafalwalla’s conduct, resulting in the suspension of his medical license on or about March 25, 2025.

The Jacob D. Fuchsberg Law Firm, LLP filed a lawsuit against Modern MD Management Services, LLC, ModernMD Urgent Care – Woodhaven, and Dr. Sitafalwalla on behalf of our client and his partner in the Supreme Court of the State of New York, County of New York, on August 11, 2025. 

The complaint alleges that Dr. Sitafalwalla’s sexual abuse of our client was a result of Modern MD truing a blind eye to Dr. Sitafalwalla’s obvious sexually abusive behavior. The lawsuit filed on behalf of our client and his partner seeks general and special damages for the permanent injuries that our client was caused to suffer as a result of Modern MD and Dr. Sitafalwalla’s conduct.
