Shannon A. Montgomery, a partner at the Jacob Fuchsberg Law Firm, handles personal injury and medical malpractice cases, with a focus on claims with the September 11th Victim Compensation Fund.

Shannon is in charge of a team representing individuals and their families who were harmed as a result of the terrorist attacks on the World Trade Center on September 11, 2001. Our clients include people who were harmed or killed during the attacks themselves, who suffered injuries in the debris removal efforts that took place in the immediate aftermath of those crashes, or who lived and worked in the immediate area.  Shannon manages their claims for compensation through the Victim Compensation Fund established by the James Zadroga 9/11 Health and Compensation Act of 2010 and reauthorized in 2019 and has recovered millions of dollars on behalf of her clients.  She is honored to represent these victims and help ease the burden of the pain suffered as a result of their exposure.

Shannon also handles matters before the Surrogate Court in New York, including administration and probate petitions, as well as compromising and distributing funds received from wrongful death settlements obtained by the firm.

Verdicts & Settlements:

  • $2.49 Million awarded from the September 11th Victim Compensation Fund to an electrical engineer who selflessly volunteered with the rescue and recovery teams, who was diagnosed with acute myeloid leukemia and passed away as a result of his toxic exposure at the World Trade Center site during rescue and recovery operations.
  • $2 Million awarded from the September 11th Victim Compensation Fund to Local 1 Union member who maintained the elevator systems at the WTC, who was diagnosed with severely back and respiratory injuries as a result of his toxic exposure at the World Trade Center site during rescue and recovery operations.
  • $1.2 Million awarded from the September 11th Victim Compensation Fund to a New York City Police Officer who was diagnosed with cancer and severely disabling respiratory injuries as a result of her toxic exposure at the World Trade Center site during rescue and recovery operations.
  • $1 Million awarded from the September 11th Victim Compensation Fund to a cleanup worker who was diagnosed with acute myeloid leukemia and passed away as a result of her toxic exposure during the cleanup and recovery operations.
  • $1.2 Million awarded from the September 11th Victim Compensation Fund to a trading assistant who was caught in the dust cloud of the collapse on September 11, 2001, and then returned to work downtown for another year, and was diagnosed with gastrointestinal cancer and disabling side effects as a result of his toxic exposure in the downtown area. 
  • $1.4 Million awarded from the September 11th Victim Compensation Fund to a Con Edison employee who participated in the utility restoration efforts within the New York City Exposure Zone on behalf of ConEd and was diagnosed with chronic myelomonocytic leukemia (CMML) and passed away as a result of his toxic exposure at the World Trade Center site during rescue and recovery operations.
  • $1.5M for a 44-year-old woman with a diagnosis of Alport’s disease and a prior history of a deceased-donor kidney transplant, who suffered from a post-operative thrombosed renal artery following an elective surgery.  It was alleged that due to negligent care post-operatively, the plaintiff lost her transplanted kidney, requiring regular dialysis.  The case was settled during a court sponsored mediation while awaiting trial.
