Negligent Discharge From Hospital

The Jacob Fuchsberg Law Firm, attorney Ed Hynes, is filing a complaint this week for a young deaf woman who was a patient in the hospital for out-patient same-day surgery.A nurse negligently discharged her before proper evaluation for her kidney function post-surgery. She had not voided post-surgery. Also, she was never provided an interpreter, and the communication with her before discharge was poor.A blood-cot or thrombus had developed in her renal artery. This medical emergency could and should have been diagnosed and quickly addressed by a common interventional catheter surgical procedure to remove the clot. Prior to this, she had only one kidney. The doctors and nurses should have been alert to the risk of injury to her sole kidney due to a thrombus from the operation. As a result, her kidney was destroyed, and she is now on dialysis and on a kidney transplant list.As part of our claim, in addition to medical malpractice, we assert that her rights under New York City Rules and Regulation law (10NYCRR 405.7A7) were violated. That a hospital shall develop a language assistance program to assure meaningful access to the hospital’s services.
