SERVING NEW YORK, NEW JERSEY, & CONNECTICUT
The Food and Drug Administration (FDA) approved Zinbryta for the treatment of multiple sclerosis (MS) symptoms in May 2016 only under specific conditions due to concern about its serious side effects. Doctors could only prescribe Zinbryta if patients tried at least two other prescription drugs and failed to find significant symptom relief. AbbVie and Biogen, Inc., manufacturers of this MS drug, withdrew it from the market in March 2018 after the FDA received thousands of patient complaints. Unfortunately, that was too late for anyone who already suffered serious side effects due to taking the drug.
If you or someone you love have experienced significant new health issues after taking this drug, we urge you to consider Zinbryta litigation. The dangerous drugs attorneys at Jacob Fuchsberg Law Firm have many years of experience fighting for the rights of clients whose lives have been irreversibly altered by the carelessness and greed of drug manufacturers. As a patient, you trust your doctor to prescribe you safe medication and may have limited knowledge of the potential hazards.
Our law firm has the resources available to investigate each of the following while preparing your case:
- Compliance with FDA regulations
- Medical cause and effect
- Potential inadequacy of warnings
- Potential wrongdoing
You typically have three years in New York to initiate a lawsuit claiming personal injury due to defective drugs. Keep in mind that it can take several months and possibly even a few years to gather evidence in your case.
The sooner you seek legal assistance, the closer you are to fighting for the financial justice you need and deserve.
What is Zinbryta?
Zinbryta is the brand name for a generic drug called Daclizumab that treats relapsing MS in adults. MS is a disease that disrupts the signals between the body and brain and causes problems with the central nervous system. Some of the most common symptoms of MS include limb weakness, numbness, balance difficulties, blurry vision, and difficulty with processing information.
The relapsing type gets its name from the fact that you can experience several symptoms for weeks or months and then have no symptoms at all. However, symptoms can reoccur, and to date, there is no curative treatment for MS. Over time, patients with relapsing MS tend to experience a worsening of neurological symptoms or new symptoms. This can leave them feeling desperate for relief that the makers of Zinbryta promised they would receive.
Zinbryta changes the way your immune system works. This occurs due to the humanized monoclonal antibody in the drug. Patients receive Zinbryta as an injection under the skin rather than taking medication in pill form.
The FDA required a warning label on Zinbryta that it could potentially cause the following serious complications:
According to the European Medicines Agency, 12 people in that region have reported experiencing behavior changes, confusion, disorientation, fever, and seizures after taking the drug. The impact went so far as to cause encephalitis or meningoencephalitis in some people and contributed to three deaths. When approving the drug for limited use, the FDA stated that its risks potentially outweighed its benefits. Despite this, AbbVie and Biogen chose to aggressively market the drug, and doctors prescribed it to their patients with relapsing MS.
Although Zinbryta was only on the market for 22 months from May 2016 to March 2018, that is long enough for it to have caused significant damage in your life.
At Jacob Fuchsberg Law Firm, our attorneys understand the challenges facing individuals living with MS, as well as the difficulties of dealing with worsening symptoms. While we can’t change your medical outcome, we can help hold those responsible for your new symptoms or injuries accountable for their wrongdoing.
Zinbryta Victims – We’re Here for You
As a medical consumer, you have the right to be informed of all the potential consequences of taking a specific drug. You can no longer make an informed decision when a manufacturer robs you of this choice. Regardless of the type of injury you sustained from Zinbryta, it’s time to hold the manufacturers of this dangerous drug accountable by filing a Zinbryta lawsuit.
Jacob Fuchsberg Law Firm would like to assist you in sending the message that withholding this crucial information in the name of profit is never acceptable. We are on your side, and we will use our extensive resources to help you seek justice and accountability. It’s our goal to be here for you every step of the way when the unimaginable happens in life.
Suffering from major side effects that you never expected affects more than just your physical health. It affects every area of your life, especially your finances. When you pursue Zinbryta litigation, it gives you the opportunity to seek financial reimbursement for the losses you have suffered.
The most common categories of compensation include:
- Past, present, and future medical expenses associated with the drug side effects
- Lost wages, including the difference in wages if you can no longer perform the same job and must accept something that pays less or requires fewer hours per week
- Physical and emotional pain and suffering
Should you experience the tragedy of losing a loved one due to Zinbryta drug effects, your case then becomes a wrongful death lawsuit. Some benefits you may receive include:
- Your loved one’s medical expenses prior to his or her death from taking the defective drug
- Funeral and burial expenses
- Loss of companionship
- Loss of economic contribution and compensation for duties your family member normally attended to such as lawn care and car repair
You may also be eligible to receive punitive damages if the jury that hears your case determines that the drug manufacturers acted in an especially reckless manner that would cause harm to a human being. In addition to compensating you for your suffering, punitive damages also punish the offender and act as a strong deterrent to other drug manufacturers who might attempt the same thing.
