What's New > $1.45 Million for 21-year-old Laborer Injured When Steel Rods Fall from Truck


Partner Alan Fuchsberg recently settled the case of a construction worker who was injured while unloading steel rods from a flatbed truck; an unsecured load of the ‘rebar’ rolled off, repeatedly striking the young man and crushed his legs. He underwent several surgeries, a bone grafts as well as replacement of the hardware holding his leg together, including a femoral rod, fixated with nails, screws and end cap

The day laborer, who did not understand English, also suffered permanent knee and ligament damage. He continues to experience severe knee and joint pain, locking of the knee, stiffness, swelling, severe limitation of movement, and impairment of gait.

Mr. Fuchsberg filed suit against the trucking company, its owner and driver and the subcontractor handling the rebar installation; under New York Labor Law, he also sued the general contractor for the work site and He obtained a $1.45 settlement fro lost wages, pain and disabilities.
